1. Acceptance of Terms

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Services.

2. Eligibility

You must be at least 18 years or the age of majority in your jurisdiction to use our Services. By using the Services, you represent and warrant that you meet this eligibility requirement.

3. Use of the Service

YathaAI provides an AI-powered conversational interface. You agree to use the service only for lawful purposes. You shall not use the service to transmit any content that is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, or otherwise unlawful in any manner whatever, as outlined in Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

4. Prohibited Technical Use

In addition to the general usage restrictions above, you specifically agree not to use YathaAI — including its AI responses, outputs, or APIs — for any of the following purposes:

• API proxying or relay services: Building, operating, or distributing any software, tool, or service that proxies, relays, or re-exposes YathaAI's outputs or the underlying third-party model APIs (such as Anthropic or Google) to other users or systems.
• Circumventing third-party authentication: Using YathaAI to bypass, circumvent, or work around API key requirements, authentication mechanisms, or access controls imposed by any third-party AI provider.
• Redistributing or reselling model access: Redistributing, sublicensing, or reselling access to AI model capabilities obtained through YathaAI's platform, whether commercially or otherwise, without our express written consent.
• Automated credit abuse: Using scripts, bots, or automated tools to exploit the credit system, including but not limited to sending high-volume requests designed to obtain AI responses beyond your purchased credit entitlement.

Repeated or egregious violations of this section may result in immediate suspension or permanent termination of your account, without prior notice and without refund of any remaining credits.

5. Payments & Billing

YathaAI operates on a pay-per-use model. Credits purchased are non-refundable unless explicitly stated otherwise or required by law. Pricing is subject to change with prior notice. All payments are securely processed via Razorpay.

6. Third-Party Services

Our Services may contain links to or integrations with third-party platforms (such as LLM providers and payment gateways). We are not responsible for the content, policies, or practices of any third-party services.

7. Limitation of Liability

To the maximum extent permitted by law, YathaAI acts as an intermediary under Section 79 of the Information Technology Act, 2000. We do not guarantee the accuracy, completeness, or usefulness of any AI-generated content. The service is provided "as is" and "as available". In no event shall YathaAI, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services.

8. Indemnification

You agree to indemnify, defend, and hold harmless YathaAI, its affiliates, directors, employees, and partners from any claims, damages, liabilities, and expenses arising out of your use of the Services or violation of these Terms.

9. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of YathaAI and its licensors. You retain all rights to the data you input into the system.

10. Termination

We may suspend or terminate your access to our Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

11. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts in India.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on our website with a new effective date. Your continued use of the Services after such changes constitutes your acceptance.
